Please read these Terms of Service carefully before using the services offered by Houston's Courier Inc. By using our services or opening an account, you agree to be bound by these terms.
1. Acceptance of Terms
By using any services provided by Houston's Courier Inc. ("Houston's Courier," "we," "us," or "our"), whether in person, by phone, online, or through our client portal, you agree to these Terms of Service. If you do not agree to these terms, you may not use our services. These terms constitute the entire agreement between you and Houston's Courier regarding your use of our services.
2. Services Provided
Houston's Courier provides same-day courier and delivery services throughout the Houston metropolitan area, including but not limited to: same-day local delivery, medical specimen and equipment transport, legal document filing and retrieval, cargo van delivery, and downtown bicycle messenger services. Services are subject to availability and geographic limitations. Houston's Courier reserves the right to decline any delivery request at its sole discretion.
3. Account Registration
To access our online scheduling and tracking portal, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Pricing & Payment
Delivery rates are determined by factors including distance, package size and weight, service type, and time of pickup. Rates are subject to change without notice. Payment is due in accordance with the terms of your account agreement. Accounts in arrears may be suspended. Houston's Courier reserves the right to require prepayment for new or high-risk accounts.
5. Package Restrictions
You agree not to tender for delivery any item that is: illegal under federal, state, or local law; hazardous or dangerous materials without proper authorization; live animals; currency, precious metals, or negotiable instruments without prior arrangement; perishable goods without appropriate notification; or any item exceeding our declared weight and size limits without prior arrangement. Houston's Courier reserves the right to inspect any package at any time.
6. Liability Limitations
Houston's Courier's liability for loss or damage to any shipment is limited to the lesser of the actual value of the package or $100 unless additional declared value coverage is purchased in advance. Houston's Courier is not liable for: consequential, incidental, or special damages; delays caused by weather, traffic, or events outside our control; losses arising from inaccurate delivery information provided by the customer; or damage to fragile items not appropriately packaged.
7. Claims
Any claim for loss or damage must be submitted in writing within 30 days of the scheduled delivery date. Claims submitted after this period will not be accepted. Houston's Courier will investigate all claims and respond within a reasonable time. The filing of a claim does not relieve the customer of the obligation to pay any amounts owed to Houston's Courier.
8. Confidentiality
Houston's Courier acknowledges that some deliveries involve confidential materials, particularly for legal and medical clients. Our couriers are trained to handle such materials with discretion. However, Houston's Courier does not guarantee the confidentiality of any package contents and recommends that clients take appropriate steps to protect sensitive materials.
9. Modifications to Terms
Houston's Courier reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Harris County, Texas.
